Penn St. and how it affects tOSU

So a friend of mine posted this question on his facebook today,

So if Penn State players can transfer without penalty, but Ohio State still has scholarship limits imposed, which NCAA ruling takes precedence if a PSU player wants to transfer to tOSU?

This is what the NCAA said regarding scholarship caps.

"Additionally, even if a Penn State player wants to transfer to a school that is already at its 85-scholarship cap, the NCAA said it would work with institutions on a case-by-case basis to facilitate that transfer." -from pennlive

So the question is, can tOSU potentially get some of these players and escape their scholarship restrictions? My inclination is that the NCAA will be much harsher on the buckeyes than they would be on a school not on probation. What do you guys think?
